Terms and Conditions

Break into Sales (“BIS,” “we,” “our,” or “us”) provides career coaching and tailored recruitment insights to help job candidates secure careers in technology sales (“Tech Sales”), also known as software sales. These Terms and Conditions (“Terms”) govern all use of our Services, including ad-hoc coaching, our 60–90 Day Academy, and all related materials, tools, and resources.

By enrolling in or using any BIS Services, you agree to these Terms. If you do not agree, you must not register for, purchase, or use our Services.

1. Definitions

For the purposes of these Terms:

  • “Services” means all coaching, training, consulting, and materials provided by BIS, including but not limited to the 60–90 Day Academy, ad-hoc coaching, and related tools.
  • “Academy” means the structured 60–90 day program designed to prepare clients for a Tech Sales career.
  • “Client,” “Student,” “you,” or “your” means any individual purchasing, enrolling in, or using BIS Services.
  • “Materials” means all proprietary content, templates, dashboards, video resources, and other intellectual property provided during the course of Services.

2. Scope of Services

BIS provides:

  1. Ad-Hoc Coaching Services — including, but not limited to, resume editing, interview preparation, and job search strategy.
  2. 60–90 Day Academy — a structured program delivering education, coaching, and tools necessary to pursue a Tech Sales career.

While BIS makes every effort to provide high-quality coaching and resources, results depend on the Client’s own efforts, participation, and market conditions.

3. Intellectual Property Rights

All Materials provided during the course of the Services are the sole property of BIS and are protected under the Copyright Act (R.S.C., 1985, c. C-42) and other applicable Canadian intellectual property laws.

Without express written permission from BIS, you must not:

  • Copy, reproduce, distribute, publish, or share BIS Materials with any third party.
  • Use BIS Materials for commercial purposes or in connection with any competing business.

Unauthorized use of BIS Materials constitutes infringement and may result in legal action.

4. Testimonials and Marketing Representations

  • Testimonials and success stories published by BIS are based on the experiences of actual clients.
  • For privacy reasons, some names, images, or direct quotes may be anonymized or fictionalized while remaining representative of real outcomes.
  • You acknowledge that your personal results may vary.

5. Refund Policy

BIS offers a conditional refund policy for students enrolled in the 60–90 Day Academy, as follows:

Eligibility Criteria

To qualify for a refund, you must:

  1. Program Completion — Attend every scheduled coaching session during your Academy program.
  2. Networking Efforts — Send 15–20 networking requests per day to relevant industry contacts, as instructed by your BIS coach, and maintain accurate records of these requests.
  3. Job Applications — Submit applications to all target companies agreed upon with your BIS coach.
  4. Documented Efforts — Maintain documentation of all networking and application activities, including dates, contacts, and company names, and make these records available to BIS upon request.
  5. Communication of Dissatisfaction — Clearly express dissatisfaction with your coaching services during the program to your BIS coach, allowing BIS reasonable opportunity to address concerns.

Outcome-Based Requirement

You must not have received any formal job offer in Tech Sales within 90 days after completing the Academy.

Refund or Continued Coaching

If all conditions above are met:

  • You may request a full refund of your Academy tuition; or
  • You may elect to continue working with your BIS coach at no additional cost until you secure a job offer.

Refund Exclusions:
Refunds will not be provided to Clients who fail to meet all participation, effort, and documentation requirements, or who decline reasonable opportunities for coaching or job applications.

6. Payments

  • All fees for BIS Services must be paid in full or according to an agreed payment schedule before Services are rendered.
  • Late or incomplete payments may result in suspension or termination of Services.
  • Fees are expressed in Canadian dollars unless otherwise stated, and applicable sales taxes will be added in accordance with the Excise Tax Act (GST/HST rules).

7. Privacy and Data Protection

BIS complies with the Personal Information Protection and Electronic Documents Act (PIPEDA) and applicable provincial privacy laws.

We collect, use, and disclose your personal information for purposes including:

  • Delivering coaching and training services.
  • Processing payments.
  • Communicating with you about your program.
  • Improving our Services.

8. No Guarantee of Outcomes

By using BIS Services — including ad-hoc coaching, enrolling in the Academy, or accessing curated content published on the BIS website or provided by BIS coaches — you acknowledge and agree that BIS makes no guarantee of specific outcomes. This includes, without limitation:

  • Securing job interviews.
  • Receiving a job offer.
  • Achieving a specific salary range or compensation level.

All career advancement results depend on factors outside BIS’s control, including your own effort, qualifications, industry conditions, and employer decisions.

9. Limitation of Liability

To the maximum extent permitted under Canadian law:

  • BIS shall not be liable for indirect, incidental, special, or consequential damages, including loss of earnings or opportunities.
  • Any claim against BIS is limited to the amount paid for the specific Service giving rise to the claim.

10. Governing Law and Jurisdiction

These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein. Any disputes shall be resolved exclusively in the courts of Ontario, Canada.

11. Changes to Terms

BIS may update these Terms at any time. Updated versions will be posted on our website with a new Effective Date. Your continued use of our Services constitutes acceptance of any changes.
