Welcome to Break into Sales ("Company", "we", "our", or "us"). These Terms of Service ("Terms") govern your access to and use of our coaching services, programs, and digital products ("Services"). By enrolling in or using our Services, you agree to these Terms in full. If you do not agree, you must not access or use our Services.

1. Nature of Services

Break into Sales provides educational and career-coaching services designed to help individuals prepare for, apply to, and secure jobs in technology sales roles. We do not guarantee employment, job placement, or any specific result. While our coaching is designed to support your efforts, outcomes ultimately depend on a wide range of individual and external factors including your own actions, qualifications, and labor market conditions.

2. Client Responsibilities

To get the most value from our program and be eligible for our 90-Day Job Guarantee, you are expected to:

  • Attend all scheduled coaching sessions or provide at least 24 hours notice to reschedule
  • Complete all assignments, including resume work, interview prep, and outreach tasks as instructed
  • Follow the advice, recommendations, and action plans provided by your coach
  • Communicate regularly and act in a coachable, responsive manner
  • Notify us promptly when receiving interviews or job offers
  • Submit any requested proof of participation, effort, or job applications when asked

Failure to meet these responsibilities may void your eligibility for a refund.

3. 90-Day Job Guarantee Policy

We offer a money-back guarantee if you do not receive at least one job offer in tech sales within 90 days of completing the program, provided that:

  • You complied with all responsibilities described above
  • You did not limit your job search by declining offers based on location, company, title, or entry-level status
  • You submit a refund request in writing within 7 days of the 90-day period concluding
  • You cooperate with our team and provide supporting documentation of your participation and effort

Refunds will not be issued if:

  • You voluntarily withdraw or fail to complete the program
  • You violate these Terms or behave unprofessionally toward coaches or potential employers
  • You are unresponsive, disregard advice, or fail to attend sessions or complete required work
  • Broader labor market conditions such as hiring freezes, economic downturns, or regional disruptions prevent job offers

Break into Sales retains full discretion in evaluating refund eligibility under the Guarantee.

4. Fees and Payments

  • All fees are due in full at time of enrollment unless otherwise stated in writing
  • We do not offer partial or prorated refunds except as described in the 90-Day Job Guarantee section

5. Coaching Materials & Confidentiality

All resources provided—including but not limited to worksheets, templates, guides, session recordings, and proprietary frameworks—are the exclusive property of Break into Sales.

You agree not to:

  • Copy, share, resell, publish, or distribute any materials beyond your own personal use
  • Use any materials for commercial purposes, resale, or use in your own coaching, training, or consulting business

Any unauthorized use or distribution of our content constitutes a breach of these Terms and may result in legal action.

6. Testimonial Use Disclaimer

Our website, marketing material, and program pages may feature testimonials, case studies, or success stories that reflect the experiences of clients.

  • Some testimonials are anonymized using generalized role titles (e.g., "Previous Bartender") to protect client privacy
  • In some cases, testimonials are paraphrased, shortened, or combined to summarize common sentiments gathered through free or informal coaching engagements
  • All testimonials reflect real feedback but should not be interpreted as a guarantee of success
  • Individual outcomes vary based on numerous factors including experience, effort, responsiveness, and external conditions

7. Disclaimer of Warranties

You acknowledge that:

  • Break into Sales does not guarantee job placement, income level, interviews, or any specific result
  • All services are provided "as is" without warranties of any kind, express or implied
  • We expressly disclaim any warranties of merchantability or fitness for a particular purpose

8. Limitation of Liability

To the fullest extent permitted by law:

  • Break into Sales is not liable for any indirect, incidental, special, or consequential damages
  • Our total liability for any claim related to our Services will not exceed the amount you paid for enrollment

9. Termination

We reserve the right to terminate your access to our Services if you:

  • Violate these Terms
  • Exhibit unprofessional, disruptive, or dishonest behavior
  • Fail to fulfill client responsibilities or actively engage with the program

10. Intellectual Property

All coaching tools, resources, and content provided by Break into Sales are protected intellectual property. By accessing our Services, you are granted a limited, non-transferable license to use the content for your personal benefit only. Reuse, reproduction, or distribution without written consent is strictly prohibited.

11. Governing Law and Jurisdiction

These Terms are governed by the laws of the Province of Ontario, Canada. Any disputes arising out of or relating to these Terms or the Services provided shall be resolved exclusively in the courts located in the City of Toronto, Ontario.

12. Modification of Terms

We reserve the right to update or modify these Terms at any time. In the event of material changes, we will notify you via email or on our website. Your continued use of the Services after such modifications constitutes acceptance of the updated Terms.
